Welcome to Fit with BradNelz. A global online fitness and nutrition brand founded by Bradley and Chanel Olyn.
By purchasing, subscribing to, or using our services, you agree to these Terms & Conditions. Please read them carefully, as they form a legally binding agreement between you (“the Client,” “you”) and Fit with BradNelz (“we,” “us,” “our”).
1. Purpose of Agreement
These Terms govern:
All online and in-person coaching, fitness, and nutrition services.
Access to our website, applications, coaching platforms (e.g., My PT Hub), and communication channels.
All digital products, ebooks, guides, and educational content sold or provided under the Fit with BradNelz brand.
Your continued participation constitutes acceptance of these Terms, which may be updated from time to time.
2. Description of Services
Fit with BradNelz provides customized and semi-customized wellness services, including:
Personalized fitness programming and exercise coaching.
Nutrition guidance, recipe planning, and calorie tracking support.
Access to digital tools such as the Fit with BradNelz App or third-party integrations.
Regular check-ins, accountability sessions, and lifestyle assessments.
Digital products, educational content, and performance tracking.
We reserve the right to modify or enhance our services to improve client experience.
3. Eligibility for Participation
You confirm that:
You are at least 18 years of age, or have parental/guardian consent.
You are in suitable health to participate in exercise and nutrition programs.
You will disclose any pre-existing medical or dietary conditions prior to participation.
You understand that participation is voluntary and done at your own risk.
We reserve the right to decline or terminate services if information provided is incomplete, false, or misleading.
4. Duration & Commitment
All 1:1 coaching plans carry a minimum 3-month commitment, unless otherwise stated.
After the minimum term, subscriptions automatically renew monthly until cancelled in writing.
Clients who cancel before completing the initial term remain liable for the full 3-month fee.
Commitment ensures adequate time for coaching impact and accountability.
5. Health & Medical Disclaimer
You acknowledge that:
Fit with BradNelz coaches are not doctors, dietitians, or physiotherapists.
Coaching advice does not substitute for medical treatment, diagnosis, or prescription.
You should consult your physician before engaging in any new fitness or dietary program.
You assume full responsibility for your physical and mental health during participation.
We are not responsible for injuries, health issues, or complications resulting from improper technique, non-compliance, or failure to follow medical guidance.
6. Client Responsibilities
You agree to:
Follow all coaching guidance and instructions.
Communicate progress, challenges, and health updates promptly.
Complete required check-ins on time.
Use the Fit with BradNelz App or platform for communication.
Maintain professionalism and respect across all interactions.
Failure to comply may result in limited results or termination without refund.
7. Pricing & Payment Structure
All fees are listed in South African Rand (ZAR) unless otherwise noted.
Fees are payable monthly in advance via Paystack, Stripe, PayPal, or EFT.
Subscriptions auto-renew each billing period unless cancelled per Section 9.
Payments are final once processed and non-transferable.
Price changes take effect at the next billing cycle after notice.
7.1 Payment Failures
Failed payments lead to temporary account suspension.
Two consecutive failures may result in cancellation.
Outstanding balances remain payable.
7.2 Tax & Billing
Prices include applicable VAT unless stated.
Clients must ensure their payment method supports recurring billing.
8. Refund Policy
Because our programs are personalized and digital:
No refunds are provided after access begins.
Refunds apply only if:
Duplicate payment or billing error.
Proven technical issue prevented access.
30-Day Progress Guarantee — if a client followed the program 100 % and showed no measurable progress, one-month refund may be considered.
Refund requests must be sent to info@fitwithbradnelz.com within 7 days of payment.
Approved refunds are processed within 5–10 business days to the original payment method.
9. Cancellation Policy
To cancel after the minimum term:
Send written notice to info@fitwithbradnelz.com.
Provide at least 5 business days’ notice before the next billing date.
After cancellation:
Access continues until the end of the paid period.
No pro-rata refunds for unused time.
Auto-renewals cease from the next billing cycle.
Late notice may cause one final charge before termination.
10. Pause & Transfer Policy
Pauses may be granted for up to 30 days (medical, travel, personal).
Must be requested in writing.
Programs are non-transferable.
11. Rescheduling & Missed Sessions
Missed sessions/check-ins are non-refundable.
24-hour notice required to reschedule.
Repeated no-shows may forfeit sessions.
12. Termination by Fit with BradNelz
We may terminate services immediately if you:
Engage in abusive or disrespectful conduct.
Repeatedly miss payments or breach these Terms.
Share confidential materials or misuse intellectual property.
No refund is granted for terminations due to misconduct.
13. Client Conduct
Maintain professionalism at all times. Do not:
Harass or abuse staff or clients.
Share other clients’ information.
Upload inappropriate content.
Misrepresent your identity.
14. Intellectual Property Rights
All Fit with BradNelz materials (workouts, nutrition plans, videos, images, guides, branding) remain our exclusive property.
You receive a personal, non-transferable license for individual use only.
Reproduction or redistribution without written consent is strictly prohibited.
15. Confidentiality
All client information is kept strictly confidential and used only for service delivery.
We do not sell or share data with third parties for marketing.
Confidentiality extends to group discussions and shared client spaces.
16. Data Protection & Privacy
Fit with BradNelz complies with:
Protection of Personal Information Act (POPIA) of South Africa.
General Data Protection Regulation (GDPR) principles where applicable.
16.1 What We Collect
Name and contact details.
Payment references (not card numbers).
Voluntary health and fitness data.
Platform usage information.
16.2 How We Use Data
To deliver coaching and track progress.
To communicate updates and resources.
To improve our services and client experience.
16.3 Storage & Security
All data is stored securely with encryption and limited access.
Payments are processed via PCI-DSS-compliant gateways (Paystack, Stripe, PayPal).
16.4 Client Rights
You may request access, correction, or deletion of your data at any time by emailing info@fitwithbradnelz.com.
17. Cookies & Tracking Technologies
Fit with BradNelz uses cookies and similar technologies to enhance user experience, analyze traffic, and personalize content.

Cookies are small files stored on your device to help us remember preferences and improve functionality.

18. Media Release & Testimonial Use
By providing testimonials or photos, you grant Fit with BradNelz permission to use them in marketing materials.
You may withdraw consent by email at any time.
19. Technology & Platform Access
Our app requires stable internet access.
Login details are personal and must not be shared.
We are not liable for third-party outages or data loss.
20. Liability Disclaimer
To the maximum extent permitted by law:
We are not liable for injuries or losses arising from participation.
We are not liable for indirect damages.
Our total liability is limited to the amount paid within the last three months.
You assume responsibility for your actions and release Fit with BradNelz from liability except for proven gross negligence.
21. Indemnification
You agree to indemnify Fit with BradNelz, its owners, and employees against any claims arising from your breach of these Terms or misuse of services.
22. Force Majeure
We are not liable for delays caused by events beyond our control (natural disasters, outages, strikes, etc.).
23. Promotions, Free Trials, and Discounts
Promotions are time-limited and non-transferable.
Free trials convert to standard plans unless cancelled before expiry.
Discounts cannot be combined with other offers.
24. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Disputes shall be handled by competent South African courts.
25. Dispute Resolution
Both parties agree to resolve disputes amicably before pursuing legal action.
If unresolved, matters will proceed under South African law.
26. Updates & Amendments
Fit with BradNelz may update these Terms periodically.
Changes take effect upon posting on our website.
Continued use constitutes acceptance of updates.

28. Entire Agreement
